Important: Trading Involves Financial Risk
Trading stocks, ETFs, futures, options, and other financial instruments involves substantial risk and can result in significant financial losses.
You may lose some or all of the money committed to a trade. Certain leveraged transactions, including futures and margin trading, can result in losses greater than your initial investment or deposit.
Market Watch 360 is designed to help users observe and understand market information. It is not designed to make trading decisions for you. Every trading decision, including whether to enter, exit, hold, or avoid a position, remains entirely your responsibility.
Please read this information before relying on Market Watch 360 as part of your market-analysis workflow. This disclaimer discusses instruments that may not be supported by the current application; it does not state that data or analysis for every instrument is currently available. The same general risk principles apply to any additional markets or instruments analyzed by future versions.

1. Market Watch 360 Is an Information and Educational Tool
Market Watch 360 is a Windows desktop application that displays and analyzes financial market information. The application may present stock prices and changes, market breadth, weighted index contributions, market leaders and laggards, bullish and bearish conditions, moving-average information, candle-based analysis, swing highs and lows, chart patterns, market structure, and other calculated market indicators.
These features are intended to help users study and interpret market activity. They are not personalized financial advice, investment recommendations, or instructions to execute trades. Market Watch 360 is not presented as a brokerage service or individualized investment advisory service. The application does not place trades or execute orders.
2. No Buy or Sell Recommendations
Market Watch 360 may identify conditions as bullish, bearish, positive, negative, rising, falling, strengthening, weakening, or otherwise directional. These descriptions are based on mathematical calculations, technical conditions, and available market information.
A bullish condition does not mean you should buy. A bearish condition does not mean you should sell or enter a short position. A technical condition does not guarantee that the market will continue moving in that direction. An indicator may change, reverse, remain inconclusive, or produce a misleading interpretation.
No displayed condition should be treated as a guaranteed trading opportunity. Users must independently evaluate whether any trade is appropriate.
3. Risk of Trading Stocks
Stock prices can rise or fall rapidly. Investors and traders can lose a substantial portion or all of the money invested in an individual stock. Stock-market risks include:
- Sudden price changes
- Earnings announcements and economic or geopolitical events
- Trading halts, price gaps, reduced liquidity, and volatile market conditions
- Company-specific financial problems and unexpected market closures
Buying stocks, selling stocks short, and trading with borrowed funds involve different risks. Short positions and margin trading may expose customers to losses greater than their initial capital. Market Watch 360 does not eliminate these risks.
4. Special Risk Warning — Futures Trading
Futures contracts commonly involve leverage. Because only a portion of a contract's notional value may be required as margin, relatively small market movements can produce substantial gains or losses. A futures trader may:
- Lose the entire amount deposited for trading or lose more than the initial deposit
- Be required to provide additional margin on short notice
- Have positions liquidated by a broker and remain responsible for a deficit after liquidation
- Experience rapid losses during volatile market conditions
Stop-loss or other risk-management orders do not guarantee that a position will be closed at the intended price. Price gaps, limited liquidity, exchange restrictions, and unusual market conditions can make it difficult or impossible to exit at a desired price.
Customers trading ES, NQ, YM, or other futures contracts must understand the specific risks, contract specifications, margin requirements, and obligations associated with those instruments. Market Watch 360 does not guarantee that information about an underlying stock index will accurately predict movement in an associated futures contract. Before trading futures, review the official risk disclosures provided by your futures broker.
5. Options, Leveraged Products, and Other Instruments
ETFs, options, and other leveraged or derivative instruments can involve significant risk. An option buyer may lose the premium paid, while certain option-selling strategies may expose traders to substantially greater losses.
Leveraged and inverse products can behave differently from their underlying benchmarks, particularly over longer holding periods. Market Watch 360 information should not be treated as a product-specific trading recommendation for these instruments. Customers are responsible for understanding the products they choose to trade.
6. Bullish and Bearish Indicators Are Mathematical Interpretations
Market Watch 360 may use mathematical methods such as:
- Moving averages and price changes
- Weighted stock contributions and market-breadth calculations
- Candle patterns and momentum or trend comparisons
- Swing-high and swing-low analysis
- Other technical measurements
These calculations describe conditions in the data being analyzed. They do not establish what the market will do next. A bullish EMA alignment does not guarantee higher future prices. A bearish breadth reading does not guarantee an index decline. A move beyond a swing level does not guarantee a sustained move. Technical indicators can produce false signals and change as prices update.
7. Weighted Index Calculations and Estimates
Market Watch 360 may calculate weighted stock contributions, estimated index points, points-per-$1 sensitivity, market participation, and other measurements. These calculations depend on:
- Available price information and its timing
- Selected stock baskets and index weights or reference holdings
- Calculation methods, market sessions, and corporate actions
- Source-data timing and other relevant inputs
Some values may be estimates or approximations rather than official index-provider calculations. A selected group of 10, 15, 20, 25, or 30 securities may represent only part of a larger index.
The S&P 500, Nasdaq-100, and Dow Jones Industrial Average use different weighting methodologies; their calculations are not interchangeable. Stock-index calculations must not be assumed to equal corresponding futures-market prices or movements.
8. Real-Time Market Data May Have Limitations
Market Watch 360 is designed to update market views as new information becomes available through supported market-data connections. However, data may be:
- Delayed, incomplete, incorrect, outdated, or stale
- Temporarily unavailable, revised, or corrected later
- Limited to particular exchanges
- Affected by provider or network interruptions
Different providers may display different prices or bid/ask information because they use different feeds, sources, reporting rules, or coverage. Real-time data from one exchange is not necessarily the same as consolidated market data. Do not assume every number shown reflects the latest executable market price.
Before placing a trade through a separate brokerage or trading platform, independently verify relevant market information and order details.
9. Software and Technology Risks
Like any software application, Market Watch 360 may occasionally experience:
- Software or calculation errors
- Data-feed interruptions, network failures, or delayed display updates
- Charting problems, unexpected application shutdowns, or temporary service unavailability
- Incorrect or incomplete information and third-party provider outages
A displayed value may fail to update during an interruption, and an indicator or ranking may be affected by missing or outdated data. The absence of an error message does not guarantee that all information is current or complete. Market Watch 360 should not be relied upon as the only source for decisions involving financial risk.
10. Use Market Watch 360 Alongside Other Tools
Market Watch 360 is intended to complement a trader's existing research, charting, brokerage, risk-management, and decision-making methods. It is not a replacement for independent analysis.
Customers should consider multiple sources of information, their own financial circumstances, and the risks associated with the instruments they trade. We encourage users to understand the calculations and limitations of any indicator before including it in a trading strategy.
11. Historical Results, Examples, and Illustrations
Our website, educational materials, videos, software demonstrations, and application screenshots may include historical market charts, past index values, example stock prices, hypothetical calculations, technical examples, illustrative trading scenarios, or historical weighted contributions. These examples are provided for education and explanation.
Historical results do not guarantee future market performance. Hypothetical examples do not represent guaranteed or necessarily achievable trading outcomes. Any future simulation, backtest, or performance illustration must be identified appropriately and should explain relevant assumptions and limitations.
12. No Guarantee of Profits or Trading Success
Market Watch 360 does not promise:
- Profitable trades, accurate market predictions, or winning trading signals
- Reduced trading losses or improved investment returns
- Successful trading strategies or guaranteed indicator accuracy
- Specific financial results
No indicator, analytical model, chart, mathematical calculation, or software application can eliminate market risk. Purchasing, subscribing to, or using Market Watch 360 does not guarantee better trading performance.
13. Individual Trading Responsibility
You are responsible for every trading decision you make. This includes decisions involving:
- Entry and exit prices, position size, and whether to trade at all
- Leverage, margin, stop-loss levels, and trading strategies
- Risk exposure and portfolio allocation
Market Watch 360 does not know your complete financial circumstances, objectives, risk tolerance, or personal obligations. Trade only after considering whether the risks are appropriate for your circumstances. Do not risk funds you cannot afford to lose. If you need personalized investment, tax, or financial guidance, consult an appropriately qualified professional.
14. Third-Party Platforms and Execution
Market Watch 360 may connect to supported third-party market-data providers. Those providers operate independently and may have their own terms, fees, risks, and availability requirements.
Market Watch 360 does not control a customer's brokerage platform, exchange execution, order fills, slippage, margin policies, or account liquidation procedures. Users who choose to trade do so through separate services under the applicable broker and exchange rules. Nothing displayed by Market Watch 360 guarantees execution at a particular price.
15. Customer Reviews and Experiences
Customer testimonials and statements about the usefulness of Market Watch 360 describe individual experiences and opinions. They do not represent verified trading performance, guarantees of success, or recommendations to enter particular trades.
A customer's positive experience using the software does not mean that another customer will achieve the same results or benefit financially from trading.
16. Limitation of Responsibility
Market Watch 360 provides software and analytical information, not trade execution or individualized financial advice. Customers acknowledge that financial-market decisions involve risks beyond the control of the software provider.
To the extent permitted by applicable law and the governing purchase and license agreements, Market Watch 360 disclaims responsibility for trading or investment losses arising from customer trading decisions or reliance on market information, technical indicators, or analytical interpretations.
Nothing in this disclaimer excludes responsibilities or consumer rights that cannot lawfully be excluded. Any applicable warranty limitations and limitations of liability are described further in our Terms of Use and Software License Terms.
17. Important Acknowledgment
By choosing to use Market Watch 360 in connection with financial-market activity, customers should understand that Market Watch 360 shows market information; it does not tell you what to trade. A bullish or bearish condition is a mathematical observation, not an instruction. Trading stocks, futures, and other financial instruments can result in substantial losses.
Customers are responsible for independently evaluating risks and making their own decisions. The software is intended to be used alongside other market-analysis tools and sound risk-management practices.
